CurveChecker Terms of Service
Last updated: Jul 12, 2026
These Terms of Service ("Terms") govern your access to and use of the CurveChecker website at curvechecker.com and the CurveChecker report service (together, the "Service"), operated by Energy Risk and Claims Consulting LLC ("CurveChecker," "we," "us," "our"). By creating an account, submitting materials, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
CurveChecker produces an independent, informational one-page summary (the "One-Pager") of the fire pump test report or related test data that you submit. The One-Pager restates and charts the data contained in the materials you provide — including the pump's test points plotted against its nameplate curve — and presents observations derived from that data.
The Service is informational only. No site visit is performed, no witness testing is conducted, and we do not independently verify the data, conditions, findings, or recommendations in your materials. CurveChecker is not affiliated with, approved by, endorsed by, or certified by NFPA, any other standards body, any insurer, or any authority having jurisdiction (AHJ). References to NFPA 25 or other standards are provided for context only and do not constitute a compliance determination.
We may use automated and AI-assisted tools to read and extract data from your uploads and to produce the charts, calculations, and observations in the One-Pager.
2. Accounts
You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for activity under your account. Notify us promptly of any unauthorized use.
3. Your responsibilities
You represent and warrant that: (a) you are authorized to submit the materials you upload; (b) submitting them does not breach any confidentiality or other obligation you owe to a third party; and (c) the underlying test data and materials are, to your knowledge, accurate and complete. The One-Pager can only be as reliable as the data you submit. You are responsible for reviewing the One-Pager against your original report, for the accuracy of the materials you submit, and for retaining all original reports and records.
4. Your content and the license you grant
You retain ownership of the reports, test data, documents, and photos you submit ("Customer Content"). You grant CurveChecker a limited, non-exclusive, worldwide license to host, store, process, and analyze Customer Content to provide the Service and produce your One-Pager.
You also grant us the right to create and use de-identified, aggregated data derived from Customer Content — data that does not identify you, your customer, or any facility or site — to operate, improve, and benchmark the Service, including the development of industry pump-performance benchmarks. We will not use identifiable Customer Content for purposes other than providing the Service, except as permitted in Section 5 or our Privacy Policy.
5. Confidentiality
We treat Customer Content as confidential and will not sell it or disclose identifiable Customer Content to third parties, except: (a) to service providers bound by confidentiality who help us operate the Service; (b) as you direct; or (c) as required by law or to establish or defend legal claims.
6. Fees and payment
Each account may receive a limited number of One-Pagers at no charge, as stated on the site at the time of submission. After that, a watermarked preview is provided at no charge and the clean, shareable One-Pager is unlocked by payment of the fee shown at checkout (currently USD $99 per report, one time). Fees are presented before you incur them. Payments are processed by a third-party payment processor; by paying, you also agree to that processor's terms. Unless required by law or stated otherwise at purchase, fees are non-refundable once the clean One-Pager has been delivered — you can review the watermarked preview before you buy. You are responsible for applicable taxes.
7. Intellectual property
The Service, including the CurveChecker name and brand, the analyzer, its scoring and evaluation logic, chart and report formats, software, and all related materials, are owned by CurveChecker and protected by intellectual-property laws. The analysis methods and underlying logic are confidential trade secrets. We grant you a limited, non-transferable license to use the One-Pager you receive for your own internal and business purposes, including sharing it with your customer, insurer, or AHJ in connection with the underlying test report. You may not copy, resell, reverse engineer, or attempt to derive our methods, or use the Service to build a competing product.
8. Acceptable use
You agree not to: misuse the Service; upload unlawful content or content you lack the right to submit; attempt to gain unauthorized access to other users' data or to our systems; interfere with the Service; submit volumes of material intended to extract our methods or outputs; or use automated means to scrape the Service. You will use the Service in compliance with applicable laws.
9. Disclaimers
THE SERVICE AND THE ONE-PAGER ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. We do not warrant that the One-Pager is error-free, that it accurately reflects your test report, or that it satisfies any code, standard, insurer, or AHJ requirement. The One-Pager is a summary of the data you provide and does not replace the underlying fire pump test report, the required NFPA 25 inspection, testing, and maintenance activities, any repair, insurer requirements, or AHJ approvals, and must not be relied upon as the sole basis for any life-safety, compliance, insurance, underwriting, or operational decision. Where the One-Pager and the underlying test report differ, the underlying test report controls.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURVECHECKER AND ITS OWNERS, MEMBERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR FOR PROPERTY DAMAGE OR BODILY INJURY, ARISING OUT OF OR RELATING TO THE SERVICE OR ANY ONE-PAGER. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO CURVECHECKER FOR THE ONE-PAGER GIVING RISE TO THE CLAIM (OR USD $100 IF NO FEE WAS PAID). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless CurveChecker and its owners, members, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your Customer Content, your use of the Service, your reliance on or distribution of a One-Pager, or your breach of these Terms.
12. Third-party services
The Service relies on third-party providers for hosting, file storage, payment processing, and AI processing. We are not responsible for the acts or omissions of those providers, and their services are governed by their own terms.
13. Term and termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Sections that by their nature should survive termination (including Sections 4–7 and 9–15) will survive.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with a new "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance.
15. Governing law and disputes
These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict-of-laws rules. The exclusive venue for any dispute that is not resolved informally will be the state or federal courts located in Oklahoma, and you consent to their jurisdiction. We encourage you to contact us first to resolve any concern.
